In March of 2026, SEA 285 was signed into law by Gov. Mike Braun. The new law took effect Wednesday, July 1 2026 and bans so-called "street camping," punishable by a new Class C misdemeanor with potential for jail time, fees, and other consequences for Hoosiers experiencing homelessness.
A group of shelter service providers from around the state and members of the Hoosier Housing Needs Coalition have created a resource for anyone to use in sharing essential information about the law. Here is what we want you to know.
Do you work in homeless services? Download this information as a 3x5 card or 8.5x11 flyer.
If You Camp On Public Land...
Beginning July 1, you may be asked to move from your camping area
-
Law enforcement may now approach and ask you to move along with your belongings
-
If you do not move at least 300 feet within 48 hours, you may be cited or arrested
If you are approached by law enforcement...
-
Try to remain calm
-
If you are issued a warning, you have 48 hours to move
-
If you do not move within 48 hours, you may be cited/arrested
-
Escalation could result in additional charges
If you are cited/arrested
-
You have the right to a lawyer
-
Ask what shelter beds/services are available within 5 miles
-
Make a note of the response, especially if none are available
-
Ask what will happen to your belongings
If you choose to move, make a note of your old and new locations in case you need to prove you moved 300ft.
If you are cited/arrested, ask for a lawyer. Lawyers are aware of defenses like lack of available services and recent release from mental health treatment under certain conditions.
How to use this tool...
Print the flyer/card and make copies available for neighbors. The QR code for more information will direct users back to this webpage.
Use the resource box to write a phone number for a service provider or trusted friend/relative of the person receiving it.
This resource was created by a group of service providers and steering committee members of the Hoosier Housing Needs Coalition. We thank them for their support.
